Terms & Conditions - Variation

These Terms and Conditions shall not be varied except by agreement in writing by both parties.

Photo Shoot Availability

Miss Boudoir® & Miss Boudoir X(TM) photo shoot and makeover services are available to women aged 18 and above. If you book in with Emma, you are confirming that you are aged 18 or over. Proof of age may be required for younger looking clients.

Gift Cards

Gift Cards and vouchers must be paid for in advance before shipping to the required address. Gift Cards and vouchers are available for one year from purchase date, are non-transferable and have no cash value.

Booking

A non-refundable deposit of £200.00 is required to secure your appointment date and time with the remaining balance of your package due at the time of your session. Your deposit is non-transferable.

Cancellations & rescheduling

If you need to cancel your shoot indefinitely, your deposit is non refundable. If you need to reschedule your shoot, please give Miss Boudoir® as much notice as possible so other clients can be booked in.

Emma requires a minimum of 48 hours for rescheduling otherwise your deposit will be forfeit. However, Emma does understand people get ill and nothing can be done about this, so she will do what she can to try and fill your appointment or make alternative arrangements to save loss of deposits where possible.

Allocated Photographic Time

A certain amount of time is allocated for each client depending on the package booked. Packages may not be downgraded after a date and shoot time has been booked.

Stylists

If you book the stylist with your package, you may not decide against the booking of this service at a later date.

Studio & Shoot Guests

To ensure there is no discomfort during Emma's photo shoots for her, the stylist or the client, the studio will be a no men allowed area. If you do require a person present with you, please bring a female friend/family member who is 18+.

Set Selection

Each client will have a choice of sets for their package. Sets need to be submitted 2 working days prior to the clients shoot via Emma's Boudoir Backstage site or email.

One reminder email will be sent to the client and if no set choice is received 2 day before the shoot, Emma will choose a selection at random which will not be changeable on the day. Available sets are subject to change without notice.

Clients Viewing Galleries

Online viewing galleries supplied for each client will come with a username and password and will be online for 60 days. This time can be extended at the client's request.

Your private galleries consist of a Develops Gallery containing all the digitally hand developed images from the shoot and a Photographers Choice Gallery. The Photographers Choice Gallery will contain a selection of Emma's favourite shots that she has retouched and applied effects to as a visual example of what can be done on any image you choose. The amount of images retouched as an example will be Emma's decision and done in the time allocated to that client in relation to the photo shoot length they've had. Some clients request more retouching than others and this obviously effects the amount of shots retouchable in the allocated time.

Galleries are for the purpose of selecting images and products required by the client. Any misuse of the galleries as personal websites, for copyright infringement etc will result in the client's galleries being removed and all images being deleted; this will be decided at Emma's discretion.

Retouching

Emma's prices include retouching/ image effects (excluding the Session Disc) and will be done at her discretion and in the usual Missy Style (what you see in her galleries). Artwork services and tattoo removal are subject to extra cost and will depend on the extent of the work required.

Any retouching, effects, artwork or tattoo removal requested will be completed and previewed by the client online and confirmed as satisfactory before sending to the lab for printing. All confirmation by the client is final.

Ordering Products & Payment

All products must be paid for in advance before any work is carried out on your images. All sales are final. You may pay by Debit Card online, over the phone and in studio, cash or BACS.

Product Colour Accuracy

Emma uses the best professional photographic labs for all her products and produces photographic results as accurately as possible. Product and print colours may differ from what you view online due to client's individual computer settings and monitors. Miss Boudoir® cannot be held responsible for this.

Product Timescales

Processing and product timescales specified are an estimate only and while Emma does her best to get orders to clients as soon as possible, she cannot be held responsible for any delays incurred due to photographic suppliers/labs turnaround and postal strikes/force majeure or delays which are out of her control.

Delivery & Packaging

All items will be shipped by courier or first class recorded delivery to the address supplied by the client. A signature will be required for all deliveries. Overseas deliveries will be subject to extra cost.

Plain packaging will be used at all times for complete confidentiality. The delivery time specified is an estimate only and while Emma does her best to get orders to clients as soon as possible, she cannot be held responsible for any late deliveries and subsequent loss or damage due to shipping problems out of her control.

Returns

In the unlikely event that your product(s) are damaged or defective upon arrival at the given address, you are entitled to return your product(s), which must be received by Emma within 7 days of you receiving them for an exchange (excluding digital images or digital media). Please notify Emma by phone or email and return to the below address via recorded delivery. You must provide proof of postage. If faulty, Emma will replace your product immediately. If your return a product that is not faulty Emma reserves the right to return the product to you.

Your Privacy

Miss Boudoir ® has no right to use any images from client's sessions without their permission. Emma likes to showcase work from a variety of clients photo shoots on her website, in photographic competitions, magazine articles and for promotional purposes but only with their prior permission.

If you have had a session with Emma and would like to be featured, please email Emma with your request.

Pricing & Information

Prices, product and service information is subject to change without notice. If you booked a package with Miss Boudoir® before any price change, you will be charged the package cost at the time of booking which will be on your booking form.

Websites

All website content on www.missboudoir.com, www.missphotography.com and www.missboudoir-x.com is subject to change without notice.

Any problems, glitches or information wrongly displayed in error will be rectified as soon as Miss Boudoir® becomes aware of a problem.

Miss Photography® (2478361), Miss Boudoir® (2478363), Miss Boudoir Photography® (2479389) & Miss Boudoir X™ are trademarks of Emma Jones.

These brands and marks associated with them can only be used by Emma Jones and are a sign of professionalism, high quality and trust for Emma's services.

Copyright

Any text or images, copies of text or images, whether stored physically, digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of Emma Jones at all times throughout the world.

All website content on www.missboudoir.com, www.missphotography.com and www.missboudoir-x.com is the creation and property of Emma Jones and subject to copyright. No part of any of these websites may be used without written permission by Emma Jones.

License to Use

Digital images purchased by the client remain the copyright and property of Emma Jones throughout the world. All digital images come with a legally binding License To Use document giving the client the legal right to use and reproduce the images as stated in the License.

Clients are not permitted to sell any images for profit or gain or grant usage to a 3rd party for profit or gain e.g. selling images to magazines or newspapers for financial gain. Further usage must be negotiated and written permission granted by Emma Jones beforehand.

Misuse of digital images will result in the License To Use being revoked.

Artistic License

Emma Jones shall be granted artistic license in relation to the direction, style advice, pose guidance, amount of images taken and photographic and retouching style offered throughout her service.

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by Miss Boudoir®, the client or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Force Majeure

Miss Boudoir® shall not be liable for any losses, including loss of data (due to forces beyond her control), costs, damages, claims and other liabilities which arise as a result of any delay, reschedule or cancellation of appointments, completion of orders or interruption in, or any non-delivery, or missed delivery due to circumstances beyond her or any of her product suppliers reasonable control (including, but not limited to illness, injury, fire, power outage, lightning, explosion, disorder, flood, industrial dispute, sabotage and weather conditions).

In the unlikely event of a cancellation by Emma due to illness or injury, you will be offered the option of a reshoot at a later agreed date or a full refund of monies paid.
